Terms of Service

1. Acceptance of Terms

By creating an account on itemzz.io, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

These terms form a binding agreement between you and itemsnest GmbH, Berlin, Germany (VAT: DE348793078).

2. Description of Service

itemzz.io is a home operations management platform that allows you to:

• Inventory and manage household items
• Track spaces, contracts, finances, and documents
• Manage household members and contacts
• Plan and project household finances

The service is provided as software-as-a-service (SaaS) and is accessible via web browser.

3. Account Registration and Security

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. Notify us immediately at hello@itemzz.io if you suspect unauthorised access.

One person may not create multiple accounts to circumvent plan limits. itemsnest GmbH reserves the right to terminate duplicate accounts.

4. Acceptable Use

You may use itemzz.io for lawful personal and household management purposes only. You may not:

• Use the service for commercial resale or sublicensing
• Attempt to gain unauthorised access to other users' data
• Upload content that is illegal, harmful, or infringes third-party rights
• Use automated tools to scrape or extract data at scale
• Reverse engineer or attempt to extract the source code

5. Your Data and Privacy

You retain full ownership of all data you enter into itemzz.io. By using the service, you grant itemsnest GmbH a limited licence to store and process your data solely to provide the service.

We do not sell your data to third parties. See our Privacy Policy for full details: itemzz.io/privacy

You can export all your data at any time (Account Settings → Your Data) and delete your account and all associated data at any time (Account Settings → Danger Zone).

6. Subscription and Billing

Free plan: Available to all users at no cost, subject to usage limits (1 board, 50 items, 100 MB storage).

Paid plans: Starter (€4/month), Pro (€9/month), and Family (€14/month) plans are available with expanded limits. See itemzz.io/pricing.

Billing: Payments are processed by Mollie B.V. By subscribing, you authorise recurring charges to your chosen payment method. All prices include applicable VAT.

Cancellation: You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods.

Price changes: We will notify you at least 30 days before any price change. Continued use after the effective date constitutes acceptance.

7. Service Availability

We aim to provide reliable uptime but do not guarantee uninterrupted availability. We may perform maintenance with or without notice. We are not liable for losses caused by downtime.

8. Termination

By you: You may delete your account at any time in Account Settings.

By us: We may suspend or terminate your account if you violate these terms, engage in fraudulent activity, or if required by law. We will provide notice where reasonably possible.

Upon termination, your data will be deleted within 30 days except where retention is required by law (e.g. payment records under German commercial law — HGB §257).

9. Limitation of Liability

To the maximum extent permitted by applicable law, itemsnest GmbH is not liable for:

• Loss of data (use the export function regularly)
• Indirect, consequential, or incidental damages
• Losses arising from third-party service outages (Supabase, Mollie, etc.)

Our total liability in any 12-month period shall not exceed the amount you paid us in that period, or €100, whichever is greater.

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under German law.

10. Intellectual Property

itemzz.io, its design, code, and branding are owned by itemsnest GmbH. You may not copy, reproduce, or create derivative works without written permission.

You retain all rights to your own content and data.

11. Governing Law and Jurisdiction

These terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.

If you are a consumer resident in another EU member state, you retain the right to bring proceedings in the courts of your country of residence.

12. Changes to These Terms

We will notify you by email at least 14 days before material changes take effect. Continued use after the effective date constitutes acceptance. If you do not agree, you may delete your account before changes take effect.
